How Does SkillDx Protect my Content?

We understand how valuable your content is and are committed to helping you protect it.

SkillDx employs anti-piracy technology, including encoding videos using a proprietary player and attaching a SkillDx watermark to all videos. This is why, when you load a video to SkillDx, there is both uploading AND “processing” time, because we are encoding your videos to make them difficult to steal.

For a motivated Pirate, however, any content that appears on a computer screen is vulnerable to theft.  This is unavoidable and a problem across the industry.  Giants like Netflix, Youtube, Amazon, etc. all have the same issue, and as an industry, we continue to work on new technology solutions to limit Piracy.

 

Because pirating techniques currently outpace protection, we hired a company who is specifically dedicated to enforcing the DMCA laws on your behalf and target violating individuals, hosting sites, and DNS servers in an attempt to get any unauthorized content removed. This company, Link-Busters, employs a team of professionals trained in DMCA law to go after piracy issues you bring to us.  For more info on Link-Busters, feel free to take a look at their site: https://link-busters.com/

 

Unfortunately, because of the nature of piracy, many of these sites operate outside the law and are very difficult to get shut down, despite the best efforts of our team.  Not every country has copyright laws and some pirate sites ignore lawful notices they are sent. However, when we do send Link-Busters after pirated SkillDx courses, we are successful many times.   

Can I Use Content That May Have a Copyright?

If you think that the material that you are using might be infringing upon somebody else’s idea or content, we would suggest not including it in your course. The easiest way to check whether it is ok for you to use somebody else’s content in your course is to contact them directly and ask for their permission. 

Ultimately, SkillDx cannot advise on any copyright issue and takes no responsibility for the material that you place on our platform. Remember that you retain the rights to all of the content that you place on SkillDx and that we are simply the platform through which you deliver that material.

How do I Report a SkillDx Course Infringing my Copyright?

SKILLDX COPYRIGHT POLICY

Reporting Claims of Copyright Infringement:

SkillDx takes claims of copyright infringement seriously. We will respond to notices of alleged copyright infringement that comply with applicable law. If you believe any materials accessible on or from www.skilldx.in (the “Website”) infringe your copyright, you may request removal of those materials (or access to them) from the Website by submitting written notification via this form. (Please note that this form is English only.)

 

In accordance with the Online Copyright Infringement Liability Limitation Act of the Digital Millennium Copyright Act (17 U.S.C. § 512) (“DMCA”), the written notice (the “DMCA Notice”) must include substantially the following:

• A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

• Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.

• Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit SkillDx to locate the material (i.e., the URL of the webpage containing the material).

• Information reasonably sufficient to permit SkillDx to contact you, such as an address, telephone number, and, if available, an electronic mail address at which you may be contacted.

• A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

• A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

If you fail to comply with all of the requirements of Section 512(c)(3) of the DMCA, your DMCA Notice may not be effective.

Please be aware that if you knowingly materially misrepresent that material or activity on the Website is infringing your copyright, you may be held liable for damages (including costs and attorneys’ fees) under Section 512(f) of the DMCA.

Counter-Notification Procedures:

If you believe that material you posted on the Website was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us (a “Counter-Notice”) by submitting written notification to copyright@skilldx.in. Pursuant to the DMCA, the Counter-Notice must include substantially the following:

• Your name, address, and telephone number.

• Identification of the material that has been removed or to which access has been disabled and the location (URL) at which the material appeared before it was removed or access to it was disabled.

• A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.

• A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which SkillDx may be found, and that you will accept service of process from the person who sent us the takedown notice or an agent of such person.

• Your physical or electronic signature.

The DMCA allows us to restore the removed content if the party filing the original DMCA Notice does not file a court action against you within ten business days of receiving the copy of your Counter-Notice.

Repeat Infringers:

It is SkillDx’s policy in appropriate circumstances to disable and/or terminate the accounts of users who are repeat infringers. 

What Should I do if I Find a Course on a Pirate Site?

But for a motivated pirate, any content that appears on a computer screen is vulnerable to theft.  This is an unavoidable problem across the industry.  Companies like Netflix, Youtube, Amazon, etc. all have the same issue, and like them, we continue to work on new strategies and solutions to limit piracy.

As part of that strategy, SkillDx has hired a company who provides anti-piracy services. In August 2020, SkillDx expanded its partnership with Link-Busters to include proactive scanning of Google search results as well, an effort we call our “Piracy Detection Program.” Under this Program, Link-Busters is dedicated to enforcing the DMCA laws on a number of key courses and for these courses they proactively go after piracy issues you bring to us. 

In addition for all our other instructors who are not part of the “Piracy Detection Program,” if you find your course on a pirate site, you can submit a request using this form and Link-Busters will then proceed to send a complaint on your behalf. Please make sure to include all the requested information. Link-Busters will validate requests within approximately one week of submission and file a takedown complaint as appropriate.

Please note that because of the nature of piracy, many of these sites operate outside the law and are very difficult to get shut down, despite the best efforts of our respective teams.  Not every country has copyright laws and some pirate sites ignore lawful notices they are sent.  In these cases a request is also sent to Google so that the relevant link will be removed from their search engine results.  This makes it harder for someone to potentially find and download your course for free.

Course Material & Price: Rules and Guidelines

To deliver a consistent student experience, SkillDx courses must meet minimum standards for approval. The Quality Review Team will help you get your course approved when you submit your course for review. We reserve the right to re-review courses if instructors violate these standards at any point.

What is valuable educational content?

Since SkillDx is a marketplace for educational content, your course material should be designed with student learning in mind, not personal promotion.

The course material is the actual content of the course and includes:

• Section/lecture titles

• Videos or other lecture types

• Resources

• Quizzes

The course needs to meet our detailed list of quality review guidelines in order to be available in the marketplace. If we find that a course in the marketplace does not meet our quality review guidelines, we reserve the right to re-review the course.

You may add multiple instructors to a course when they help create, develop, teach or manage the course. It is not an option that should be used simply to augment marketing capabilities and reach more students. For detailed guidelines on when to add other instructors to your course

Detailed Course Material Guidelines

The course material is meant to help students learn within a safe environment. It is not meant to be used for instructors to market or sell to students in any way or form. If this happens, it results in students feeling distrustful because they’re being sold to when they want to learn. To learn how to create a great course, click here.

• The course material needs to meet our quality review guidelines and may only include information relevant to your course topic. 

• Courses should not contain content that is duplicated in other courses published on the marketplace. Any overlap in content across your courses must remain minimal.

• You may include your website, social media profiles, or contact information as a small watermark on your video throughout the lecture or briefly at the beginning or end of a lecture. Learn more about the specifics in this article.

• You may not include links to paid content off SkillDx. The only exception is you’re providing access to a tool/product that is part of the Course Requirements, which is stated in the Course Landing Page.

• You may not post personal information about students.

• You may not include affiliate links.

• You may not include coupon codes, links or promotional references to any SkillDx courses.

• When adding an external link to your course that requests students to pay or provide personal information, please use the following guidelines to decide where you can include the link.

When it comes to deciding whether the link is relevant to the course or not, we will take context into account. This is where the spirit of the policy matters, so unless you can prove to our team that this material provides value to your students within the course, please don’t include it!
 

When an instructor is clearly going against the spirit of SkillDx policies in an attempt to game the system or if we see a severe negative impact on the student experience (high unsubscribe rates or refund rates) it will be considered a violation of our policies.

Where is Your Link Placed in Your Video?

You may include your website, social media profiles, or contact information as a small watermark on your video throughout the lecture. Please do not use distracting placement or colors.

• You may show your website, social media profiles, or contact information at the beginning or end of your lecture video as long as they only appear briefly on the screen. You may not use a full lecture to provide this information.

Price Setting
When creating a course, you will be prompted to select a free or Premium (Paid) for your course from a list of available price tiers. Alternatively, you may choose to offer your course for free. As a premium skilldx instructor, you will also be given the opportunity to participate in certain skilldx programs under the terms of our Skilldx Premium Instructor Policy that will give you a chance to be part of SkillDx Hybrid Digital Program/University.
You give us permission to share your courses for free with our employees, with selected partners, and in cases where we need to restore access accounts who have previously purchased your courses. You understand that you will not receive compensation in these cases.
